Trump Administration passes on biofuels court appeal

The Trump Administration has let the clock run out on the opportunity to appeal a federal court decision on Small Refinery Exemptions, or S.R.E.s.

Earlier this year, the U.S. Court of Appeals for the Tenth Circuit struck down three small refinery exemptions improperly granted by the Environmental Protection Agency.  The ruling stems from a 2018 challenge brought against the federal agency by a handful of agriculture and biofuel groups. 

The Renewable Fuel Standard dictates refineries must blend specific amounts of ethanol into the nation's gasoline supply. Oil companies argue this requirement puts undue hardship on small refineries, hurting their bottom line. Ethanol industry leaders and corn growers counter that the waivers issued by the EPA adversely impact the renewable fuel industry and undermine the RFS.


Reuters reports the Trump Administration is likely to comply with the ruling and follow it on a national level.
